Terms of Use

By accessing and using Transient Files ("the Service"), you ("User") enter into a binding agreement with us ("Service Provider") and agree to comply with the following terms and conditions:

Definitions

  • "User" refers to any individual or entity accessing or using the Service. File uploaders bear primary responsibility for content compliance, while downloaders are responsible for their use of accessed content.
  • "Content" refers to all files, data, metadata, and associated information uploaded to or processed by the Service.
  • "the Service" refers to the Transient Files web application, accessible at transientfiles.com, which provides temporary file hosting and sharing capabilities.
  • "Service Provider" refers to the operators and maintainers of the Transient Files platform.
  • File Retention Policy: Files uploaded to the Service have customizable expiration times (1 hour, 12 hours, 24 hours, or one-time download) and optional download limits set by the uploader. Files are automatically and permanently deleted when they reach their expiration time, exhaust their download limit, or after a maximum of 36 hours regardless of settings. Files that continue to be accessed within their limits may remain available until their specified expiration time, subject to technical and legal constraints including data protection requirements.
  • File Processing and Integrity: The Service and Service Provider do not alter, modify, scan, or process uploaded files in any manner whatsoever. Files are stored and served in their exact original form, including all metadata, EXIF data, and embedded information. Users bear sole responsibility for removing any sensitive, personal, or confidential information prior to upload.
  • Prohibited Content: Users are strictly prohibited from uploading content that is illegal under European Union or Swiss law, harmful, or violates these terms. Prohibited content expressly includes but is not limited to: (a) child sexual abuse material or content facilitating human trafficking; (b) content infringing third-party intellectual property rights or otherwise unlawful; (c) content containing sensitive personal information, inciting violence, or intended to commit fraud; (d) malicious software, phishing attempts, or other forms of technical abuse; (e) any content violating applicable European Union or Swiss federal and cantonal laws and regulations.
  • User Responsibility and Liability: Users bear sole and exclusive responsibility for all uploaded content and its compliance with applicable laws, regulations, and these terms of use.
  • Content Moderation Rights: The Service Provider reserves the absolute right to remove any content without prior notice and may suspend or permanently terminate User access for violations of these terms.
  • Service Availability: This Service is provided on an "as is" and "as available" basis without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. This disclaimer applies to the maximum extent permitted by applicable law in your jurisdiction.
  • Third-Party Infrastructure: This Service operates on Cloudflare's infrastructure platform and is subject to Cloudflare's Developer Platform Service Terms. Content determined by either the Service Provider or Cloudflare to be illegal, harmful, or violating applicable terms may be blocked, removed, or result in service suspension in accordance with Cloudflare's policies and applicable law.
  • Limitation of Liability: To the maximum extent permitted by applicable law, the Service Provider shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from or related to the use of this Service, including but not limited to damages for loss of data, business interruption, or any other commercial damages or losses.

Privacy Policy

In accordance with European Union General Data Protection Regulation (GDPR) and Swiss Federal Data Protection Act (FADP), we provide the following information regarding data collection and processing:

  • IP Address Collection: We collect and store the IP address of file uploaders based on our legitimate interest in service security and abuse prevention under Article 6(1)(f) GDPR. IP addresses are retained for the duration that the associated file remains available on our Service.
  • Technical Data Processing: We collect and process the following technical information necessary for Service functionality: (a) upload and expiration timestamps for automated deletion scheduling; (b) SHA256 hash of uploaded files for file serving and duplicate detection; (c) file size for storage management; (d) file MIME type for content classification and security filtering; (e) download counts and remaining download limits to enforce user-specified restrictions and detect abuse patterns; (f) user-specified expiration times and download limits for file lifecycle management.
  • Anonymous Download Tracking: We track download counts and enforce user-specified download limits without collecting personal information about downloaders to maintain service functionality and identify suspicious usage patterns. This tracking serves our legitimate interest in maintaining service security and honoring user-specified sharing preferences.
  • Third-Party Access Logs: Cloudflare, our infrastructure provider, may retain access logs for up to 7 days for security, performance monitoring, and DDoS protection purposes in accordance with their privacy policy.
  • No Additional Personal Data Collection: Beyond IP addresses and necessary technical data, we do not intentionally collect, process, or store any personal information or personally identifiable information.
  • Automated Data Deletion: All files, associated metadata (including SHA256 hashes, file sizes, MIME types, download counts, expiration settings, and download limits), and collected IP addresses are automatically and permanently deleted when files reach their expiration time, exhaust their download limit, or after a maximum of 36 hours, ensuring minimal data retention that respects user-specified sharing preferences.
  • Data Sharing Limitations: We do not share, sell, or transfer collected data to third parties, except as mandated by applicable law, court order, or as necessary for Cloudflare's infrastructure services.
  • User Rights: Under GDPR and FADP, Users may request information about their processed data by contacting us at the address provided below. Due to our minimal data collection and automated deletion policy, such requests may have limited applicability.

Abuse Reporting and Legal Compliance

To report content violations, legal infringements, or Service abuse:

Required Information for Reports:

  • Complete file URL or unique file identifier
  • Detailed description of the alleged violation or legal infringement
  • Applicable legal basis for the complaint
  • Your contact information for verification and follow-up communication

Response Commitment: All abuse reports will receive a preliminary acknowledgment within 24 hours of receipt. We commit to investigating all reports thoroughly and taking appropriate remedial action, including content removal and access restriction, in accordance with applicable European Union and Swiss law. Final responses will be provided as promptly as feasible depending on complexity and legal context. Please note that initial acknowledgment constitutes receipt confirmation only and does not constitute admission of liability or final determination of the reported matter.
